Recent Cert Petition Filing for Supreme Court Clinic

The Supreme Court Litigation Clinic recently filed a petition for certiorari in Castro v. United States asking the Court to hear argument on a case involving the Border Patrol’s deportation of  U.S. citizen infant.  The Clinic represents the child as well as her mother, also a U.S. citizen.  The petition concerns the scope of the Federal Tort Claims Act with respect to actions by law enforcement agents that not only give rise to state-law tort claims, but also exceed their statutory or constitutional authority.  A recent New York Times article covers the case and the filing of the petition.  The Clinic is co-counsel with Susan Watson of Texas RioGrande Legal Assistance and Javier Maldonado. Pam Karlan is the primary instructor handling the case within the Clinic and Kyle Maurer ’11 assisted with the petition over the summer. During the fall quarter, the team will include Jennifer Clark ’11, Kathryn McCann ’12, and Matthew Seligman ’11.
