The First Amendment dominates debate about freedom of speech in the United States. Yet it is not the only law that protects expressive freedom. A rich body of local, state, and federal laws also does so, and does so in ways the First Amendment does not. In this talk, Professor Genevieve Lakier will explore the important role that non-First Amendment law plays in the regulation of speech in the United States, and what this means for how we think about rights—and our constitutional structure—more generally.
