The collision between evolving First Amendment doctrine and the health care system is one of most important and fascinating issues in health law. Robert Post, the Dean and Sol & Lillian Goldman Professor of Law at Yale Law School, is one of the nation’s leading experts on the First Amendment and the author of Democracy, Expertise, and Academic Freedom: A First Amendment Jurisprudence for the Modern State.

Dean Post will discuss emerging developments in First Amendment doctrine that render its application to the provision of health care unpredictable and problematic. He will evaluate recent constitutional decisions dealing with the regulation of the professional speech of doctors, the marketing of drugs for off-label uses, and compelled informational disclosures to those who offer, or who appear to offer, family planning or pregnancy related services.
