Intellectual property, whether in the form of patents, copyrights, trademarks, or trade secrets, is a key asset in technology start-up companies. Entrepreneurs and their board of directors have to understand IP challenges from the get-go because they often implicate the future viability of the firm. IP litigation can be exceptionally expensive. Building the right patent portfolio can present crucial strategic challenges. Responding to patent trolls raises a host of related issues. Internet copyright and trademark issues can be central to a business strategy.
