In an ambitious bid to set global standards for the digital economy, the European Commission released proposals for a Digital Services Act (DSA) and Digital Markets Act (DMA) a few months ago. The DSA aims to protect consumers by providing mandatory content moderation rules, transparency obligations for online advertising, and clarifying the liability rules that apply to intermediaries. Meanwhile, the DMA seeks to introduce new ex-ante regulations for “gatekeeper” platforms, with the aim of enhancing competition and innovation within Europe’s digital single market. These proposals, which also apply to US companies operating in the EU, are currently the subject of hot debate at EU level. While we wait for final adoption of this new rulebook, our panelists will discuss the practical steps US companies can be taking to prepare their compliance tool kit as well as influence the debate.
