Summary

NFL Commissioner Roger Goodell’s decision to suspend Patriots quarterback Tom Brady for being “generally aware” of footballs that may have been deflated was wrong. U.S. District Court Judge Richard Berman found that Goodell’s preposterous arbitration process was “premised upon several significant legal deficiencies.”

And now a federal appeals court will hear the case today, and my prediction is the three judges will side with Berman, Brady, sanity and the law. The deck has been stacked in his favor since day one, and this court will see that and make the right choice.

William Gould IV, a Stanford law professor and former chairman of the National Labor Relations Board, wouldn’t even call what Goodell conducted “a real arbitration.”

“The commissioner was wrong,” he said. “This is not arbitration, and Berman’s decision should stand.”
