SUMMARY:Stanford Law Review Symposium 2026 -- The APA at Eighty: What’s Next for Administrative Law?
DESCRIPTION:The Administrative Procedure Act (APA) is the “bill of rights” of the modern administrative state. Passed by Congress and signed by President Truman in 1946\, the APA establishes the central framework ensuring that “governors shall be governed” and “regulators shall be regulated.” This landmark statute lays the foundation for all forms of executive rulemaking\, agency adjudication\, judicial review\, and public participation in the regulatory process. \nThough Congress has not substantively amended the APA in the last eight decades\, its vision of the administrative state has nevertheless undergone seismic shifts at the hands of the judiciary. In recent terms\, the Court has fundamentally changed the appointments and removals of administrative officers\, the administrative adjudication of individuals’ rights\, the role of the federal courts in interpreting regulations\, and agencies’ understanding of their statutory grants. \nThe Stanford Law Review (SLR) will convene a Symposium in the winter of 2026 both to look back on the last century of administrative law and to look forward to the next. SLR invites authors to submit manuscripts that address doctrinal\, historical\, empirical\, or normative aspects of administrative law generally or specific areas of administration (e.g.\, environmental law\, immigration law\, national security). DESCRIPTION:Watch the event \nIt has been just over three years since the Supreme Court instructed lower courts to evaluate Second Amendment challenges by examining history and tradition. And it is no secret that the courts have struggled. Overwhelmed by the task of evaluating historical claims\, lower courts instead are turning to other judges as authorities on history. They are using what Larsen calls in this article “historical precedents”—meaning language about history from an older decision that the subsequent judge then treats as authority\, not as part of the legal rule but as truth of the matter asserted. This practice presents a very interesting puzzle: once the Supreme Court blesses a historical source or a historical narrative\, does that conclusion—in and of itself—bind other courts to the same answer about what happened in the past? The question is more than just an academic head scratcher. It creates significant practical concerns. The Supreme Court is not designed to be a factfinding institution\, nor are the Justices trained historians. They can make mistakes\, or our understanding of the history can change\, and in any event some language that recites historical claims—particularly when appearing in separate opinions—is not contemplated with the kind of spotlight and scrutiny that comes when a legal rule is debated. SUMMARY:Second-Order Constitutional Theory
DESCRIPTION:Watch the event \nA sophisticated legal thinker who wishes to work out a fully developed approach to constitutional adjudication must choose two theories\, not one. The first choice is familiar. What is the best approach for finding right answers to constitutional disputes? The leading competitors are familiar\, too: theories such as originalism\, pluralism\, moral readings\, and common law constitutionalism. It turns out\, though\, that a sophisticated legal thinker must also make a second theoretical commitment. For unless one takes the implausible view that every single case is an evidentiary wipeout under their preferred first-order theory\, something more will sometimes be necessary to decide a case. That something is a second-order theory of constitutional adjudication: a theory that does not purport to make any interpretation more (or less) correct\, constitutionally speaking\, yet still guides a decisionmaker after their preferred first-order interpretive theory has run out. In this constitutional conversation\, Professor Aaron Tang will make the case for greater attention to the choice among second-order constitutional theories. He will argue that the unspoken\, second-order theory embraced by today’s Supreme Court—the 51-49 rule\, under which each justice votes for the outcome they think is supported by more first-order evidence than any other outcome\, no matter how slight the difference—is as responsible for the acrimony over today’s Court as the first-order clash between originalism and its competitors.
