Why Quantum AI Won’t Be Regulated Like Classical AI
Abstract
The regulatory principles that govern a technology are like a mirror reflecting collective fears. Classical AI (the machine learning and deep learning systems running on conventional computers that constitute current AI) regulation emerged from concerns about how AI systems affect individuals: fairness in consequential decisions, transparency in algorithmic reasoning, accountability for harmful outcomes, preservation of human judgment. Quantum AI will shatter this mirror and reassemble the pieces in an unfamiliar pattern. Where classical AI regulation emerged from fears about discrimination, opacity, and the erosion of human judgment, quantum AI regulation will emerge from fears about cryptographic collapse, weapons proliferation, and systemic vulnerability. This essay uses the AI Life Cycle Core Principles (AILCCP) framework to consider which principles will dominate quantum AI governance. It finds that Security, Safety, and Reliability will matter where Bias, Fairness, and Transparency once held center stage. Accountability and Privacy will persist but transform. Governance will benefit from hardware concentration that creates enforcement chokepoints impossible for classical AI. This shift reflects what each technology actually threatens, not what legislators and regulators prefer to emphasize.
Introduction
This essay uses the AI Life Cycle Core Principles (AILCCP) framework to ask which principles will actually matter when quantum AI arrives. Security, Safety, and Reliability will dominate where Bias, Fairness, and Transparency once held center stage. Not because regulators will choose different priorities, but because quantum AI applications will force different questions entirely.
The AILCCP framework contains 37 core principles, and quantum AI will not implicate them equally. Some will prove foundational to regulatory evolution. Others will fade to the margins, not because they lack merit, but because quantum AI simply does not raise the concerns they were designed to address. (Throughout this essay, capitalized terms refer to specific AILCCP principles; lowercase usage denotes general concepts.)
As of this writing, classical AI regulation emerged primarily around Bias, Fairness, Transparency, and Accountability concerns. Algorithmic bias in consequential decisions. Explainability for automated judgments. Accountability for harmful outcomes. These concerns drive legislation like the European Union’s Artificial Intelligence Act and various state-level efforts here in the U.S.
With quantum AI, regulation will produce different emphases among the same principles. Security will dominate where classical AI emphasized Fairness. Resilience and Robustness will matter more than Explainability. Permit and Wherewithal requirements will gate access to capabilities that classical AI made freely available. This shift is not because regulators will choose different priorities but because quantum AI applications will implicate different core principles with different intensity than classical AI applications do.
This is both prediction and prescription: if quantum AI regulation does not center on these principles, it should. Effective regulation requires matching focus to the risks a technology actually creates.
Why these particular principles and not all 37? The answer lies in how technologies create risk. Each technology activates a distinctive set of regulatory concerns while leaving others dormant. Quantum AI’s near-term applications cluster around cryptography, molecular simulation, and optimization. These domains create Security vulnerabilities, dual-use weapons potential, and technical reliability challenges. They do not make consequential decisions about individuals in ways that trigger Bias, Fairness, or Equity concerns. They do not replace human judgment in ways that activate Human-Centered oversight requirements. And regulatory principles do not activate in isolation. When an application creates cryptographic vulnerability, it simultaneously implicates Security and Cooperation. These principles travel together because the underlying risk activates them together.
Part I: Security Displaces Bias, Fairness, and Equity
Classical AI regulation revolves around a cluster of related but distinct AILCCP principles reflecting concerns about individual harm. Bias addresses protecting individuals against disparate impact, discrimination against protected classes, and unjust outcomes, while also guarding against inaccurate results. Fairness addresses managing against unintended disparate treatment of individuals and reducing unexpected outcomes. Equity addresses protecting against the widening of gender and protected class gaps. Each principle operates independently: a system might satisfy Fairness requirements (preventing unintended disparate treatment) while still raising Bias concerns (producing disparate impact), or address both without resolving Equity implications (allowing gaps to widen over time). Together, these principles drive classical AI regulatory evolution because the applications—hiring algorithms, credit scoring, criminal justice predictions—make consequential decisions about individuals that can perpetuate discrimination.
Quantum AI regulation will center on the Security principle instead because the applications are fundamentally different. Security encompasses requirements such as protecting systems and data from unauthorized access, resisting adversarial attacks, enabling threat detection and response, and maintaining supply chain integrity. Quantum computing’s cryptographic threat places Security concerns at the regulatory center.
When fault-tolerant quantum computers break RSA encryption, medical records, state secrets, private correspondence, and other sensitive data will be exposed. Current encryption depends on mathematical problems that would take classical computers billions of years to solve. Quantum computers will solve them in hours. Regulatory panic will follow, driven by Security failures rather than Bias, Fairness, or Equity failures. The response will mandate quantum-resistant protocols, require data re-encryption, and impose cryptographic readiness audits. These are Security-focused mandates with no Bias, Fairness, or Equity counterparts.
Standards bodies have already begun building the technical foundations for this Security-centric emphasis. In the U.S., the National Institute of Standards and Technology (NIST) released its first post-quantum cryptography standards in August 2024. The Federal Information Processing Standards (FIPS) 203 specify the Module-Lattice-Based Key-Encapsulation Mechanism (ML-KEM), FIPS 204 specifies the Module-Lattice-Based Digital Signature Standard (ML-DSA), and FIPS 205 specifies Stateless Hash-Based Digital Signature Standard (SLH-DSA). Together these NIST specifications provide the technical foundation for cryptographic protection that regulation will mandate.
These domestic standards do not exist in isolation. Internationally, ISO/IEC has moved in concert with NIST, updating its digital signature standards (ISO/IEC 14888) and encryption schemes (ISO/IEC 18033) to incorporate quantum-resistant approaches. More significantly, the establishment of ISO/IEC JTC 3 in January 2024 created a dedicated international body for quantum technologies. This coordinated movement across national and international standards bodies reflects a shared recognition: Security-focused requirements need global technical foundations to be effective.
When will this unfold? The timeline remains deeply uncertain and two camps dominate this debate. Skeptics observe a treadmill-like effect, quipping that useful quantum computers have remained perpetually a decade away for twenty years running. Error rates improve slowly, they note, and post-quantum cryptography standards already exist, suggesting the threat may never materialize. Optimists counter that hybrid systems where classical AI optimizes quantum circuits could accelerate timelines unpredictably, and that the very existence of post-quantum standards indicates the threat is taken seriously enough to demand preparation.
Regardless of when practical quantum computing arrives, Security will drive initial regulatory evolution rather than Fairness. The applications themselves dictate this. Quantum computers will break encryption, simulate molecules, and optimize logistics—activities that create vulnerabilities, dual-use weapons risks, and strategic competition concerns. They will not evaluate job candidates, assess creditworthiness, or predict criminal behavior, which are decision points that implicate Fairness.
What the Security principle does address will, therefore, dominate regulatory attention. This principle encompasses requirements such as adversarial resistance, information sharing, threat detection, supply chain vetting, and incident response. These requirements will drive quantum AI regulatory frameworks. Financial regulators will mandate quantum-resistant banking protocols. Healthcare agencies will require quantum-safe patient data protection. Defense contractors will face Security audits focused on quantum AI vulnerabilities. Each sector will reference the emerging NIST and ISO/IEC standards that is appropriate to its domain.
The shift is fundamental. Classical AI regulation asks whether systems discriminate and quantum AI regulation will ask whether systems maintain alignment with the Security principle. Different principles drive different regulatory frameworks, but both rest on technical standards providing implementation guidance.
Part II: Safety, Permit, and Cooperation Displace Human-Centered Oversight
If Security represents the dominant principle shift, Safety concerns present the most consequential one. Classical AI regulation emphasizes Human-Centered principles because classical AI applications replace human judgment. When an algorithm decides who gets hired, who receives credit, or who gets paroled, regulators ask whether humans remain meaningfully in control. The Human-Centered principle addresses this anxiety: compatibility with human rights, safeguards ensuring a fair society, human-collaborative functions, and human-intervention requirements. The EU AI Act’s provisions on human oversight, the NIST AI Risk Management Framework’s emphasis on human-AI teaming, state laws requiring human review of automated decisions—all reflect this focus on preserving human agency.
Quantum AI shifts the question entirely. The danger is not that quantum systems will replace human judgment but that they will enable human judgment to cause unprecedented harm. A scientist directing a quantum simulation retains full agency; the question is what that simulation might produce. Safety principles ask not whether humans remain in control but whether certain capabilities should exist at all. Classical AI raised agency questions: who decides? Quantum AI raises harm questions: what damage can these capabilities inflict?
Quantum AI regulation will center on the Safety principle. Safety encompasses requirements such as preventing harm, proactively preventing unsafe states, minimizing risks across the application’s lifecycle, incorporating real-time monitoring, and enabling return to safe operation states. These requirements gain urgency because the dual-use concern is prospective. Quantum computing could eventually enable simulation of nuclear reactions, optimization of biological agents, and modeling of chemical weapons. These capabilities, should they materialize, would emerge along the same technological trajectory as drug discovery and materials science.
This prospective nature of the dual-use threat deserves emphasis. We are nowhere close to quantum computers that could design weapons today, and weapons simulation remains speculative, likely decades away if it materializes at all. Here we encounter an apparent paradox. If regulators typically fight the last war, why would they anticipate quantum AI’s dual-use risks before those risks materialize? The answer lies in the nature of the threat. Consumer harms accumulate gradually and become visible through advocacy and individual complaints. Strategic threats operate differently. National security establishments monitor technological trajectories and act preemptively when capabilities approach thresholds that could shift power balances. This pattern is already visible: the Creating Helpful Incentives to Produce Semiconductors and Science Act (the CHIPS Act) channels quantum AI development through defense priorities even though the dual-use capabilities remain hypothetical. The act reflects Safety concerns shaping regulatory thinking well before the capabilities they address actually exist. This anticipatory posture means regulatory development will apply Safety-oriented frameworks rather than Human-Centered frameworks.
The Permit principle will extend to quantum AI. Permit addresses government-issued authorization for high-risk systems, certification requirements, and licensing of operators. Quantum AI applications with weapons-relevant potential will require permits, face export controls, and encounter strategic technology restrictions that classical AI never triggered.
ISO/IEC JTC 3’s scope explicitly includes coordination with relevant committees on sector-based applications of quantum technologies, acknowledging that dual-use concerns will require sectoral oversight. The vocabulary standard ISO/IEC 4879:2024 provides the definitional foundation for distinguishing quantum AI applications by capability and risk level. This technical taxonomy enables regulators to classify which quantum AI applications trigger dual-use restrictions.
The Cooperation principle will also shape regulatory development for dual-use concerns. This principle emphasizes information sharing to mitigate threats. We will see quantum AI security information sharing organizations emerge, analogous to existing information sharing and analysis organizations for cybersecurity threats (e.g., ISACA). ISO/IEC JTC 3 already establishes liaison relationships with multiple technical committees and standards bodies including the International Telecommunication Union and the European Telecommunications Standards Institute (ETSI), creating channels for threat information sharing.
Part III: Reliability, Robustness, and Resilience Displace Transparency and Explainability
Classical AI regulation demands explanations. Quantum AI regulation will demand results. This distinction sounds abstract but only until you watch it play out in practice. When a hiring algorithm rejects a candidate, regulators ask why. When a quantum simulation identifies a molecular structure for drug development, regulators will ask whether the structure works. The first question concerns process. The second concerns outcomes. This shift from Explainability to Reliability reflects how quantum AI systems actually behave.
Classical AI regulation emphasizes Transparency and Explainability because consequential decisions about individuals require justification. The Explainability principle includes enabling understanding of algorithmic outcomes, reducing black-box challenges, providing mechanistic interpretability, and audience-calibrated explanations. The Transparency principle addresses disclosure, discovery, stakeholder understanding, and audit facilitation. These requirements exist because credit denials need explanation, hiring rejections require reasoning, and criminal justice predictions need interpretability. The EU’s Artificial Intelligence Act and various state laws accordingly emphasize Transparency and Explainability as core requirements.
Quantum AI regulation will organize around Reliability, Robustness, and Resilience principles instead, not because Transparency is unimportant but because quantum AI systems raise different technical concerns that matter more for regulatory purposes.
The Reliability principle encompasses requirements such as consistent performance, accurate results, service quality under varying conditions, continuous validation, and alignment with marketing claims. Quantum systems face unique Reliability challenges, such as decoherence, error accumulation, noise sensitivity. These technical properties will drive regulatory attention.
ISO/IEC JTC 1/WG 14 (the Working Group on Quantum Information Technology) is developing standards for quantum computing performance metrics through liaison work with the Institute of Electrical and Electronics Engineers (IEEE) on standards including performance benchmarking. These technical standards will provide the foundation for regulatory requirements around Reliability verification. When regulators mandate that quantum AI systems demonstrate reliable performance, they will reference measurement frameworks emerging from these standardization efforts.
The Robustness principle addresses operating accurately under adversarial attacks, resisting prompt injection (a way of tricking an AI system with malicious instructions), maintaining operational integrity, handling input/output unreliability, and protecting against unintended behavior. Quantum systems face novel adversarial threats beyond classical AI concerns. Regulatory frameworks will accordingly mandate rigorous testing; ISO/IEC 17825, which addresses testing methods for how cryptographic hardware can be attacked without directly tampering with it, is already being applied and extended to post-quantum implementations.
Alongside Robustness, the Resilience principle addresses withstanding disruptions, recovering from failures, adapting to operational changes, maintaining temporal stability, and resisting drift. Quantum coherence times create unique Resilience challenges that classical systems do not face.
Regulatory evolution will focus on these technical concerns rather than Explainability concerns. When quantum AI optimizes molecular structures for drug discovery, regulators will care whether the optimization is reliable and robust, not whether the quantum AI calculations are explainable in human terms. The molecular structures either work or they do not.
The priorities invert. Classical AI regulation attempts to make automated decision systems interpretable so humans can understand and contest decisions. Quantum AI regulation will focus on verification that systems perform reliably rather than on interpreting how they perform.
Related principles reinforce this pattern and here we see the Accuracy principle, Fidelity principle, and Predictable principle. These principles will shape quantum AI regulatory frameworks because they address using credible data, operating according to specifications, and delivering consistent outputs. Quantum systems will face regulatory requirements around these performance parameters, with verification methods specified through ISO/IEC and NIST standards providing concrete testing protocols.
The shift from Explainability to Reliability reflects application differences. Classical AI makes decisions about individuals who deserve explanations. Quantum AI performs technical optimizations where Reliability verification matters more than explanation. As with Security, technical standards from ISO/IEC and NIST provide the concrete foundation for implementing Reliability requirements.
Part IV: Accountability Adapts When Interpretation Becomes Impossible
Accountability does not shift from classical to quantum AI; it breaks. The mechanisms that make classical AI systems accountable assume you can examine a system without changing it. You can log a neural network’s weights, trace decisions through a pipeline, reconstruct what happened after something goes wrong. Quantum systems do not permit this. Observing a quantum state alters it. The information you need for an audit is destroyed by the very act of auditing. The Accountability principle requires traceability, liability allocation, and audit trails. Quantum AI makes the first and third physically impossible in ways classical AI never did.
Classical AI Accountability challenges center on model opacity, diffuse responsibility across development teams, and difficulty tracing decisions through complex pipelines. But classical AI systems could be made to align with this principle through sufficient documentation, version control, and audit trails.
Quantum AI Accountability faces challenges with no classical analogue. The act of measuring a quantum system changes it; an auditor cannot examine what happened without altering the very evidence being examined. This is a physical constraint, not an engineering problem awaiting better tools. But if auditors cannot examine quantum states directly, regulators will demand records of everything else: circuit designs, computational parameters, outcomes, how classical systems shaped quantum operations. When something goes wrong, someone must still be able to trace what happened and assign responsibility. Cryptographic security standards (in the style of ISO/IEC 27001 and FIPS-style requirements) already provide a template for this. Existing requirements for audit trails and system state documentation, developed for classical cryptography, will extend to quantum systems. Though not within its current scope, ISO/IEC JTC 3 could end up developing these Accountability frameworks across quantum AI applications.
The Track Record principle becomes particularly important for quantum AI. Track Record includes developer reputation, adherence to lifecycle principles, commitment to continuous improvement, and Permits. Given quantum AI Accountability challenges, regulatory frameworks will emphasize developer Track Record more heavily than for classical AI.
If quantum AI systems cannot easily be made accountable through direct system inspection, regulators will look at developer history and practices. Organizations with strong track records of responsible development will face less restrictive oversight than organizations with poor track records. This is not optimal Accountability, which would involve direct verification of system behavior, but rather adaptation to technical constraints.
The Wherewithal principle will also shape regulatory frameworks for quantum AI Accountability. Wherewithal includes financial capacity, operational resilience, expertise, Governance structures, and contractual obligations. Quantum AI development requires extraordinary resources. Regulators will impose Wherewithal requirements ensuring that organizations deploying quantum AI have capacity to maintain systems, respond to incidents, and meet obligations. And this is where the Permit principle comes in. Wherewithal often functions as a precondition for Permit and regulators may require demonstrated financial and operational capacity before issuing authorization for certain types of quantum AI applications.
The Metrics principle offers a path forward. If quantum systems cannot be made interpretable, they can still be measured. Regulators will demand rigorous benchmarking of system behavior, performance, and reliability—demonstrating that systems work even when auditors cannot explain how. ISO/IEC JTC 1/WG 14 is already developing the technical standards for such measurement, including quantum machine learning dataset standards under ISO/IEC 18660.
Accountability in quantum AI remains important, but its implementation adapts to the system’s properties. Documentation, measurement, developer track record, and organizational capacity become Accountability attributes where direct system interpretability proves challenging.
Part V: Privacy Confronts Cryptographic Obsolescence
The Privacy principle in classical AI deals with unauthorized access, model inversion attacks, membership inference, and re-identification of anonymized data. These threats drive regulatory frameworks like the General Data Protection Regulation (GDPR) emphasizing data minimization, purpose limitation, and privacy by design. But even with data minimization, deletion, and log rotation, every encrypted message you have ever sent likely still exists somewhere. In server logs, backup tapes, archived databases. This data remains private only because breaking current encryption would take classical computers longer than the age of the universe. Quantum computers will do it in hours which creates a fundamentally different privacy threat: not unauthorized access through system breach or inference attack, but wholesale cryptographic obsolescence rendering existing protections meaningless. When the mathematical walls protecting your information dissolve, privacy as a regulatory concept will need to find new foundations.
Regulatory response will follow predictably: mandates for quantum-resistant encryption of personal data. Healthcare agencies will require patient records protected with post-quantum cryptography. Financial regulators will mandate quantum-resistant protocols for transaction data. The technical standards already exist. NIST has published post-quantum cryptography standards; ISO/IEC has developed parallel standards for quantum key distribution. These all represent different technical approaches to the same problem, and regulatory frameworks will reference both, giving organizations flexibility in how they achieve quantum resistance.
The Consent principle also faces quantum AI complications. Consent includes systemic alignment with user authorization and obtaining legally valid consent. If data collected under consent mechanisms assuming current encryption provides adequate protection, does quantum AI’s ability to break that encryption violate consent? This question will drive regulatory change around consent validity under changing security conditions.
Data Stewardship presents a different challenge. Classical AI learns from training datasets, raising familiar questions about data quality, provenance, copyright, and lifecycle management. Some quantum AI applications share this dependency; quantum machine learning often relies on training data much like its classical counterpart. But other quantum applications operate differently, simulating physical systems or optimizing quantum states without ingesting personal information at all. The tension with the Privacy principle remains the same as under existing frameworks: is the information reasonably linkable to an identifiable person? ISO/IEC 4879:2024 provides shared vocabulary for quantum computing that can support this analysis, defining quantum information, quantum states, and quantum processing with sufficient precision for regulators and technologists to communicate clearly. But the standard supplies terminology, not a privacy determination. That work still falls to legal frameworks like GDPR and their quantum-age successors.
Part VI: Governance Remains the Meta-Principle
Governance is a meta-principle. It is the single most important principle in the AILCCP because it enables all other AILCCP principles. The principle addresses organizational infrastructure: documented policies that guide development, senior leadership accountability, compliance frameworks, risk management processes, continuous learning and improvement, and alignment with recognized standards. Without Governance, every other principle becomes merely aspirational. Security requirements need organizational systems to implement them. Safety protocols require documented procedures to enforce them. Accountability demands clear roles and responsibilities to operationalize it. Governance is the operating system on which all other principles run.
The Governance principle is also about organizational capability rather than legislative or regulatory action. It asks whether the entity developing or deploying an AI system maintains the internal infrastructure to manage that system responsibly: Does leadership take documented responsibility? Are policies regularly reviewed against regulatory and operational requirements? Do procedures enable continuous monitoring and improvement? Are roles and decision rights clearly assigned? The principle recognizes that effective AI management requires institutional maturity and competence that cannot be mandated from outside but must be built and regularly maintained within organizations themselves.
In classical AI, achieving alignment with Governance is challenging primarily because the technology is highly diffused. A startup with three engineers can deploy an AI system and have no documented policies, no assigned roles for risk management, no procedures for continuous monitoring, and none of the organizational infrastructure that Governance demands. Multiply this across countless deployers and the challenge becomes clear: ecosystem-wide alignment with Governance is highly daunting, nary unachievable when most deploying organizations lack the resources, maturity, expertise, or incentives to build and maintain effective institutional alignment.
Quantum AI is different because of its structural makeup. Meaningful quantum computing capacity is concentrated, existing today only within a few organizations, numbering perhaps no more than a dozen worldwide. And the barrier to entry remains steady, anchored by technically formidable and costly requirements: cryogenic engineering, specialized supply chains, and accumulated expertise that cannot be quickly replicated. This concentration is directly translatable to scale, and this transforms the prospect for achieving ecosystem-wide alignment with Governance. Where in classical AI countless organizations, some large but most small, need to figure out how to align with Governance, when it comes to quantum AI only a few need to, and they are in a relatively better position to effectively do so. This is because they are much better capitalized, institutionally mature, and already subject to extensive regulatory scrutiny in other domains. For companies like IBM and Google, extending their Governance alignment to quantum AI represents incremental rather than transformational organizational development.
The Governance principle also includes Context Stewardship, which governs decisions about which data sources an AI system may access and synthesize. The concept recognizes that aggregated context creates combinatorial risks that no single data source would present alone. When an AI system draws from multiple inputs, it can derive inferences that were never explicitly authorized, and when those combined inputs produce harmful outputs, causal responsibility becomes difficult to attribute. For quantum AI, Context Stewardship matters because quantum systems operate within hybrid architectures: classical AI designs algorithms, prepares inputs, and interprets outputs, while quantum hardware executes computations. The quantum computation itself may be benign, but the context shaping it determines whether the overall workflow serves legitimate or harmful purposes. Organizations with robust Governance alignment stand a better chance of implementing effective Context Stewardship by establishing policies that regulate not only quantum execution but the inputs feeding it, assigning roles responsible for reviewing hybrid workflows, and maintaining procedures for monitoring how quantum capabilities interact with their broader operational environment. Such organizational sophistication is achievable only for a handful of well-resourced quantum providers.
One caveat is noteworthy, however. Technology concentrations tend to dissolve. If quantum hardware miniaturizes and democratizes, the structural advantage described above will dissipate. That said, the barriers of entry make this unlikely to happen any time soon, and the current window of concentration creates an opportunity where Governance architectures established now can become templates that future entrants adopt.
Part VII: International Coordination Follows Security, Cooperation, and Permit
Domestic AI regulators worry about unsafe drugs designed by algorithms, unstable markets driven by automated trading, unreliable research conducted with machine learning tools. These are local harms and local harms do not compel nations with different values to write common rules. And this is why classical AI regulation fragments internationally. The AILCCP framework may be common, but the emphasis on what principles matter is not. The EU treats algorithmic transparency as an extension of human dignity. The United States places trust in sectoral markets to address what federal regulation does not.
To achieve international coordination requires a different kind of threat: one that affects everyone regardless of regulatory philosophy. Cryptographic collapse is that kind of threat and so is weapons proliferation. When quantum AI can break every encrypted communication and enable weapons simulation previously reserved for superpowers, focus on Transparency, Fairness, Human-Centered, Bias and similar principles becomes irrelevant.
Quantum AI forces focus on different principles because of its capabilities. When fault-tolerant quantum computers break RSA encryption, they will not break it selectively for nations that failed to prepare. The collective vulnerability everyone faces creates collective interest in response, and this collective interest will coalesce around Security, Permit, and Cooperation. Transparency and Accountability will also be relevant, but for different reasons than under classic AI.
If weapons-relevant quantum AI capabilities materialize, coordination around Security will intensify and formalize. The reference model for this is nuclear nonproliferation and states will cooperate to prevent catastrophic capabilities from spreading. Focus on the Security principle will see controls on capability thresholds that trigger international oversight, verification regimes that allow states to demonstrate compliance without revealing proprietary methods, and export controls that restrict transfer of sensitive technologies.
