Building a Practice of Positive Change (3261): Tort litigation is usually measured in dollars. But many seriously injured people want something more: an acknowledgment, an answer, and an assurance that what happened to them will not happen to anyone else. This short course examines how tort law can drive real-world change -- through settlement terms that require defendants to reform their practices (the injunctive effect) and through litigation that brings critical safety information to light rather than burying it in secret settlements (the informational effect). The course will be taught through a 1.5-day conference at Stanford Law School that will bring together leading plaintiffs' lawyers, defense counsel, mediators, scholars (including of psychology), and injured clients themselves. Students will attend all sessions (with latitude given to students who have course conflicts on Friday morning). Elements used in grading: Attendance, reflection paper.
