Thomas Jefferson famously remarked that the Constitution should be amended frequently, since “the imperfections of a written Constitution will become apparent” in new circumstance and social conditions. Is our current moment one in which Jefferson’s prediction has come to fruition? Do problems such as partisan gridlock, judicial interventions in the culture war, or expansions of executive power display an unmistakable need for constitutional amendment? Does our Constitution need a big fix?
