Free speech is expanding under the Roberts Court. In just over ten years, the Court’s rulings have extended constitutional protection to a variety of expressive acts and actors previously unrecognized by prior free speech doctrine. Those include violent video games, animal crush videos, and perhaps most infamously, corporate spending on elections. Is the Roberts Court’s First Amendment expansionism a good or a bad thing?
