In Federalist 51, James Madison argued that an important defense against tyranny resides in what we now call checks and balances–the idea that each branch of government possess the “constitutional means and personal motives to resist encroachments of the others.” Yet does this solution continue to provide the kind of protection that the Founders envisioned, especially when the President and Congress disagree? And if Congress continues to exert meaningful checks on presidential power, how do such checks actually function in practice?
