The legal profession is built on information:  we gather, categorize, and analyze our clients’ most important information in order to help guide their decision-making in business and in law.  What happens when we can no longer guarantee the security of that information?  The issue of cybersecurity is a fundamental challenge facing the legal profession today as law firms and legal departments struggle with understanding the scope of the threats, developing plans and responses, and prioritizing the issue internally.  But cybersecurity also presents a new opportunity for the lawyer role as clients seek guidance on their own exposure and governments work to develop a systemic regulatory framework for this area.

The Stanford Center on the Legal Profession (CLP) and the Rock Center for Corporate Governance presented a panel discussion on cybersecurity and the legal profession moderated by Lucy Ricca, executive director of CLP.  The panelists were Karl Hopkins, CSO and Partner of Dentons, Kevin Hulbert, President of XKGroup, Peter LaMontagne, CEO of Novetta, Tom Moyer, Chief Compliance Officer and Head of Global Security for Apple, and Ruby Zefo, Vice President, Law & Policy Group and Chief Privacy and Security Counsel at Intel Corporation.

Karl V. Hopkins
CSO and Partner, Dentons

Karl V. Hopkins is a partner on the Firm’s Energy, Transportation and Infrastructure teams, and heads a group of practitioners providing strategic and legal advice to global energy companies, financial institutions and foreign governments. Karl also serves as Dentons’ chief security counsel. His practice concentrates on the development of international energy and infrastructure projects, and on advising clients on security strategies in relation to their global operations.In addition to advising clients in the United States, he has represented clients on matters in more than 40 countries. He has experience managing matters relating to large asset-based transactions, including the sale of oil and gas interests and the development of both onshore and offshore oil and gas production facilities, pipelines, refineries, terminals and related infrastructure projects.

In addition to his transactional experience, Karl has represented clients in various arbitration tribunals, including the American Arbitration Association (AAA), the International Centre for Dispute Resolution (ICDR), the London Court of International Arbitration (LCIA), the International Court of Arbitration of the International Chamber of Commerce (ICC) and the United Nations Commission on International Trade Law (UNCITRAL). He is a Chambers-rated lawyer for Energy and Natural Resources: Dispute Resolution.

Kevin Hulbert
President, XK Group, LLC

Kevin Hulbert is the President of XK Group, LLC. Before founding XK Group, Mr. Hulbert held a variety of high level jobs in the Central Intelligence Agency (CIA), becoming an expert on counterterrorism, counter proliferation, non-traditional operations, cyber security, and covert action.  An accomplished senior leader in the National Clandestine Service (formerly the Directorate of Operations) Mr. Hulbert served around the world and worked with many foreign liaison partners, particularly on counterterrorism issues.  From an overseas location, Mr. Hulbert led some of the Agency’s most complex counterterrorism operations abroad.  His final job in government service found him working with the Federal Bureau of Investigation (FBI) where he served as Senior Advisor for Counterterrorism.  Kevin’s years in the intelligence community dealing with complex and multifaceted issues have left him well positioned to advise clients on the myriad of complicated issues that can effect the bottom line.  Mr. Hulbert is fluent in Spanish and he holds current Top Secret/SCI clearances with full background investigation and polygraph. In 1988, he received his Masters in Business Administration (MBA) from Georgetown University where he also served as class President.

Peter B. LaMontagne
Chief Executive, Novetta

Peter B. LaMontagne is responsible for establishing and guiding Novetta’s corporate strategy as well as overall performance.

Before the formation of Novetta, Peter served as Senior Vice President and an executive lead in the cyber security practice at CACI. Prior to CACI, he was President and CEO at Paradigm Holdings, Inc., a private equity backed cyber security and digital forensics firm acquired by CACI in September 2011. At Paradigm Peter built an advanced cyber defense capability with a sharp focus on countering advanced persistent threats (APT) including penetration testing and malware reverse engineering. From 1999 through 2006, he worked at ManTech International where he played a leading role in strategic planning, acquisitions, and execution of the growth strategy, including support for the IPO and follow-on offering in 2002. Peter began his career by serving as a US Foreign Service Officer and was posted at the U.S. Embassy in Beijing, China from 1993 to 1996 and is a Mandarin linguist. Peter graduated magna cum laude from Bowdoin College in Brunswick, Maine where he majored in Government/Legal Studies and Classics, and completed his Honors Thesis on Terrorism Studies.

Tom Moyer
Chief Compliance Officer and Head of Global Security, Apple Inc.

Tom Moyer is the Chief Compliance Officer and Head of Global Security at Apple Inc. He has overall responsibility for Apple’s ethics and compliance program including Apple’s Business Conduct Policy, governing the ethical and legal obligations of Apple’s Board, executives and over 120,000 employees around the world. Tom is also responsible for Apple’s global security program including all physical security, executive protection, loss prevention, technology, security related investigations, and the security of new products and prototypes.

Tom received his undergraduate degree from UC Berkeley in Rhetoric where he graduated with highest distinction and was elected to Phi Beta Kappa. He attended Hastings College of the Law in San Francisco. Prior to attending law school, Tom served in the US military where he was responsible for the acquisition and analysis of data on Pacific Rim, Mid-East and Latin American countries. During Operation Desert Storm, he was responsible for providing “enemy situation reports” to principal commanders.

Ruby Zefo
Vice President, Law & Policy Group and Chief Privacy & Security Counsel, Intel Corporation

Ruby Zefo is Vice President, Law & Policy Group at Intel Corporation, and serves as its Chief Privacy & Security Counsel.  Ruby manages Intel’s global privacy and security legal group, whose charter is to enhance shareholder value through world-class legal counseling provided with verve and enthusiasm, on all privacy and security issues.  In addition, Ruby manages teams responsible for legal support of Intel’s IT department, Intel Security Platforms Group, and Intel’s global trademark practice.  She also co-chairs the Law & Policy Group’s first women’s leadership development program, Leading Edge.

Ruby began her law career at Fenwick & West LLP, specializing in intellectual property and general commercial litigation.  She later joined Sun Microsystems, Inc., specializing in licensing, marketing, and trademark law.  She joined Intel in 2003.

Ruby has a B.S. in Business Administration from the University of California at Berkeley, and a J.D. from Stanford Law School.  She is a frequent speaker on legal practice and leadership topics.
