Patent Venue Wars and TC Heartland

Please join Latham & Watkins and SIPA for a discussion on the one of the hottest current issues in IP- the Patent Venue Wars. Because of its patentee-friendly reputation, a disproportionate amount patent litigation cases are filed in the Eastern District of Texas. TC Heartland v. Kraft Foods was argued at the Supreme Court last month, and questions the current permissive venue laws in patent litigation. The Court’s decision will have long reaching ramifications regardless of the ruling, but if the Court overturns the Federal Circuit’s ruling, and instills stricter venue laws, the patent system could undergo a radical change.
Partner Rick Frenkel and Associate Emily Chen will talk more about the background of the current state of forum shopping in patent litigation suits, the TC Heartland case, and potential ramifications of how the Supreme Court may rule.
