DOJ has announced a series of new policy changes and priorities in recent months that may have broad implications for corporations. These come on the heels of several new or updated voluntary self-disclosure policies announced by different DOJ components between February and early March 2023. Deputy Attorney General Lisa Monaco has also revealed a number of new initiatives being undertaken by DOJ to address threats to U.S. national security and the risk of affiliated corporate crime, and has emphasized DOJ’s continued focus on incentivizing companies to seek compensation clawbacks from individual wrongdoers. Moreover, DOJ is cracking down on the use of personal devices at work and the retention of corporate communications; it announced earlier this year that it would consider a corporation’s policies around use of personal devices, communications platforms and messaging applications in determining whether a corporation should be criminally charged for the conduct of its employees or agents.
