rof. Randy Barnett, the famous libertarian constitutional and contracts scholar who authored many of your casebooks, will be coming to Stanford on Monday to speak about health care reform. Known for his controversial view that much of today’s economic regulation is unconstitutional – as outlined in his book, Restoring the Lost Constitution – he will speak on Monday about the constitutionality of the individual mandate to buy health insurance. According to Barnett and some other libertarian and conservative scholars, Congress lacks any power granted it in Article I, Section 8, to compel individuals to sign contracts against their will.
