The Marion Rice Kirkwood Moot Court Competition Semifinals will be held at 4 p.m. on Friday, January 31, in the Moot Court Room.

Round 1, 4:00 p.m.: Spencer Segal; Thomas Archibald v. Rachel Blatt; Harrison Hurt
Round 2, 5:15 p.m.: Kelsea Jeon; Brian Xu v. Jonathan Artal; Leo Rassieur

The teams will be competing before a distinguished panel of federal judges:  Judge Jacqueline S. Corley and Judge Haywood S. Gilliam of the United States District Court for the Northern District of California and Judge Rachel P. Kovner of the United States District Court for the Eastern District of New York.

This year’s case is U.S. v. Chatrie, 107 F.4th 319 (4th Cir. 2024), where Google produced location information in response to the government’s geofence inquiry that led to the discovery of evidence against the defendant.

The issues are:

  1. Whether the government’s use of a geofence inquiry was an unconstitutional search under the Fourth Amendment to the U.S. Constitution.
  2. If the government’s use of a geofence inquiry was an unconstitutional search, whether the evidence obtained as a result of the search is nonetheless admissible under the good faith exception to the exclusionary rule.
