Professor emeritus Ken Scott comments on Elena Kagan’s nomination to the U.S. Supreme Court in Politico’s Arena:
I think law professors generally would regard Kagan as very well-qualified, professionally and intellectually, which of course may not be what the Hill is interested in. As dean at Harvard, she also showed an ability to build consensus in a sometimes quite polarized environment, which is an ability that could serve her well on this court. And if the Republicans dig in for a serious battle in the Senate, I doubt that will serve them well.
