Judicial Vetting and Screening in Malaysia

Abstract

Act 695 – Judicial Appointments Commission Act 2009 and adopted Judicial Appointments Commission (Selection of Judges of the Superior Courts) Regulations 2009 provide for a detailed transparent procedure to be followed by the Judicial Appointments Commission (JAC). The JAC, who plays a major role in judicial vetting and screening process, was appointed according to the JAC Act to ensure the unbiased selection of judicial candidates for the consideration of the Prime Minister and to uphold the continued independence of the judiciary. The JAC, composed of nine members, has many functions and duties, but it’s main function is to select suitably qualified persons who merit appointment as judges of the superior court for the Prime Minister’s consideration.
