Few things are as important in school discipline as due process. We represented a student who had been expelled over 150 days after the precipitating incident, a flagrant violation of California law, in his appeal before his County Board of Education. Our brief alleged not only a timeline violation, but multiple other due process violations including a lack of notice, insufficient evidentiary basis, and the denial of a fair expulsion hearing.
