Computational Rule of Reason Analysis in Antitrust

Abstract

The goal of this paper is to reduce the rule of reason analysis in antitrust to a quantitative or computational exercise. The rule of reason consists, at bottom, as many courts have said, in balancing anticompetitive harms against procompetitive benefits. Such a balancing exercise should be amenable to precise calculation. We provide a framework here for such a computational approach to the rule of reason.
